IN LINE WITH THE PROTECTION OF PERSONAL INFORMATION ACT, 4 OF 2013 (“POPI”)

This Privacy Policy describes our policies and procedures in addition to the terms and conditions as stated on our invoices and on our website (which cumulatively are referred to as our “Privacy Policy”) on the collection, use and disclosure of your Personal Information (as defined in POPI) when you, as our client, utilise the services of Fireworks and Pyro Co (Pty) Ltd (“the Company”).

We use your Personal Data strictly in order to fulfil our services, as a fireworks, events and pyrotechnics company.  In order to fulfil the aforementioned mandate and provide satisfactory services to our clients, we need to process your personal information securely. This entails processing your personal information by directly obtaining same from you as the client, safely securing same and using same for the aforementioned purpose, but also includes disclosing certain necessary information to third party suppliers (“Service Providers” as defined below), who may be assisting the Company with the provision of supplies or services for the performance of any requested work or services by the Company towards the client.

Such information held by the Company will be processed and safely secured and should any Personal Information be required to be provided to third party suppliers, such information shall be retained and stored by such Service Providers as independent entities in line with their own privacy protocols, which we are not responsible for.

By entering into the Agreement with the Company, you agree to the collection and use of information in accordance with this Privacy Policy and our terms and conditions as aforementioned.

Definitions

For the purposes of this Privacy Policy:

  • Account means an account, agreement or contract between the client and the Company.
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Fireworks And Pyro Co (Pty) Ltd.
  • Country refers to: South Africa
  • Device means any device that is utilised for the Services we provide, such as a computer, a cellphone, a digital tablet, server or other systems network.
  • Personal Data is any information that relates to an identified or identifiable individual, of a personal nature, as defined by the POPI Act and includes Personal Information, as defined in the said Act.
  • Service refers to the services as listed on our Website, in our Agreement and as per the quotes and invoices supplied by the Company to the client.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related and necessary to the Service.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
  • Website refers to Fireworks And Pyro Co (Pty) Ltd., accessible from https://fireworksandpyro.co.za.
  • You means the individual accessing or using the Service and also referred to as the “client(s).”

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.
  • To manage your Account: to manage your registration as a user of the Service.

The Personal Data will be used to fulfil our mandate as per the Services listed in the Agreement and on our website.

  • To contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products or contracted services, when necessary or reasonably required.
  • To provide you with news, special offers and general information about our Services which are reasonably necessary to update our Clients and to fulfil our Services unless you have specifically opted out of such notifications by written notice to that effect,
  • To manage your requests: To attend and manage your requests to us.
  • For related attendances in order to fulfil our mandate: We may provide our Service Providers with your Personal Information for the fulfilment of our mandate, as referred to above.
  • For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Services, products, marketing and your experience.
  • With your consent: We may disclose your Personal Information for any other purpose with your consent.

Retention of Your Personal Data

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. By concluding an Agreement with the Company for the use of its services, you consent to this Privacy Policy (which is accessible on the Company’s website and is subject to change from time to time).

If the Company is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.
